The Republican-controlled Ohio House has passed House Bill 249, a measure that would restrict drag and gender performances and disproportionately target transgender Ohioans. The bill cleared the chamber in a 63–30 vote, largely along party lines, and now heads to the Senate. Titled “The Enact the Indecent Exposure Modernization Act,” the legislation would ban drag and gender performances outside of adult cabaret venues or in public spaces where minors may be present.
Obscenity in public performances is already prohibited under existing Ohio law. The bill includes language regulating performers who present a gender identity different from their biological sex, raising concerns among LGBTQ+ advocates about its broader implications. A separate provision redefining private area as private part could impact transgender and gender non-conforming individuals using public facilities. Opponents strongly criticized the measure. Equality Ohio CEO Dwayne Steward says, “This bill takes regular, everyday activities and turns them into potential crimes.”
