Ten years after Obergefell v. Hodges affirmed marriage equality nationwide, its foundational protections face renewed threats. Despite the 2022 Respect for Marriage Act, which codifies federal recognition of same-sex marriages, the possibility of Obergefell’s overturn by the Supreme Court remains a significant concern.

Justice Clarence Thomas has explicitly called for revisiting this precedent, echoing the sentiment that led to the reversal of Roe v. Wade. Conservative state legislatures have introduced bills aimed at undermining same-sex marriage, and a significant number of states still have dormant constitutional amendments or statutes banning it. While public support for marriage equality remains strong, a vocal minority and certain religious organizations continue to push for its undoing.

This sustained effort, alongside a broader surge in anti-LGBTQ+ legislation, casts a shadow over the stability of this established right, urging continued vigilance from advocates.
